Recently, a quick Google search told me what I already knew: the #1 worry most people have about hiring a lawyer to prepare a will is cost. According to surveys conducted by estate-planning organizations and consumer research groups, the most common reasons people delay creating a will are:

  1. “It will be too expensive.”
  2. “I don’t know how much it will cost.”
  3. “Lawyers make the process complicated or intimidating.”

The information went on to confirm something else I already knew – that after people actually complete their estate planning, many report that the process was easier and less expensive than they expected. I believe my clients would concur. As other major endeavors people face, like buying or selling their home, they often discover it was easier than they had anticipated. Not always, of course.  But one thing I like to do to put a new client’s mind at ease is to discuss fees upfront- no surprises. And when one puts it into perspective, the cost of having a legally sound and acceptable estate plan, customized to your needs and goals, complete with all the necessary documents, vs. not having a plan at all – it’s no contest.

But going beyond cost, the information said that if you ask people who are actively considering hiring a lawyer—not those avoiding it altogether—the biggest concern often shifts from cost to:

“Will this lawyer understand my family’s situation and get it right?”

People worry about:

  • Protecting children or grandchildren
  • Avoiding family disputes
  • Making sure assets go where they intend
  • Preventing costly mistakes
  • Whether they’re being sold services they don’t really need

Again, I understand those worries, so I always encourage every client to share their concerns, goals, priorities, and more to ensure the plan we build together is customized to fit exactly what they need. No cookie-cutter wills or estate plans. That doesn’t serve anyone because no two client situations are identical. Based on their goals and needs, and my many years of experience, I then provide a plan that is legally acceptable, open to interpretation, and tailored just to them. The plan will be designed to protect my client’s hard-earned assets and loved ones and will often include considerations that demonstrate the plan’s customization. Perhaps it addresses the care for a beloved pet, specific charitable donations, or ensuring family heirlooms go to the right beneficiaries.

 

One thing the online information did not mention was “peace of mind,” which I think is a big oversight. Again and again, I hear from clients that not only was the process less expensive and less time-consuming than they anticipated, but they are delighted to have a sense of accomplishment and peace of mind when it is done. Knowing they have taken the necessary steps to protect their loved ones is a huge benefit of the process. In my opinion, it is priceless.
